&lt;h2&gt;ONI testing results&lt;/h2&gt;
&lt;p&gt;Results from ONI testing reveal that Indian ISPs selectively filter sites identified by government authorities as relating to national unity and state security. ONI conducted testing on Bharti, Direct, Reliance, YOU Telecom (formerly known as Iqara), Pacenet, and VSNL. Variations in blocking among ISPs of the same limited range of sites suggest that CERT-IN and the DOT continue to rely on ISPs to implement filtering instructions. Although obscene information is the only type of content to be made illegal under the IT Act, ONI found no evidence that pornography is filtered in India. Rather, nearly all the sites filtered had already been reported publicly as blocked at some time.&lt;/p&gt;
&lt;p&gt;The only site made inaccessible by all ISPs tested were variations of the Hindu Unity Web site (&lt;a href=&quot;http://www.hinduunity.org/&quot; title=&quot;http://www.hinduunity.org/&quot;&gt;http://www.hinduunity.org/&lt;/a&gt; and &lt;a href=&quot;http://hinduunity.com/&quot; title=&quot;http://hinduunity.com/&quot;&gt;http://hinduunity.com/&lt;/a&gt;), which were blocked as a result of an order from the Mumbai police using an alternative procedure to CERT-IN. Further evidence that filtering has yet to be implemented through a uniform process can be found in the inconsistencies in filtering of the Web sites named in the CERT-IN blocking order following the bombings of suburban trains in Mumbai on July 11, 2006. On July 13, 2006, CERT-IN ordered access to seventeen Web sites blocked, reportedly because the attackers were believed to have communicated via the blogosphere. &lt;p&gt;Among the ISPs, Bharti, YOU Telecom, Reliance, and VSNL blocked the majority of sites included on the July 13 CERT-IN order. In this context, the personal Web site of a member of the Hindutva party VHP (and a university student in Indiana), &lt;a href=&quot;http://rahulyadav.com/&quot; title=&quot;http://rahulyadav.com/&quot;&gt;http://rahulyadav.com/&lt;/a&gt;, was filtered almost certainly because it was included in the July CERT-IN order, but the actual Web site of the VHP party (&lt;a href=&quot;http://www.vhp.org/&quot; title=&quot;http://www.vhp.org/&quot;&gt;http://www.vhp.org/&lt;/a&gt;) was available on all ISPs tested. &lt;/p&gt;
&lt;p&gt;In 2006, filtering requests were also generated by individuals protesting content they considered offensive or obscene. &lt;p&gt;Other sites reported by media to be filtered were done so primarily by Direct, Pacenet, and VSNL. The site about an Israeli rabbi (&lt;a href=&quot;http://www.kahane.org/&quot; title=&quot;http://www.kahane.org/&quot;&gt;http://www.kahane.org/&lt;/a&gt;) was blocked because it shares the same IP address as the Hindu Unity Web site. For example, efforts to block certain communities on Orkut, and in some instances the entire site altogether, have been initiated largely by individuals, but the government response has not resulted in the systematic blocking of Orkut by the ISPs that ONI tested. Government attempts at filtering have not been entirely effective, as blocked content has quickly migrated to other Web sites and users have found ways to circumvent filtering. The government has also been criticized for a poor understanding of the technical feasibility of censorship and for haphazardly choosing which Web sites to block. The amended IT Act, absolving intermediaries from being responsible for third-party created content, could signal stronger government monitoring in the future. &lt;/p&gt;

&lt;p&gt;Is there a precedent?  Earlier this year, the US Department of Defense banned Google from capturing Streetview images of military bases in Texas.   The British military followed suit, forcing Google to remove imagery of bases in Basra, Iraq.  &lt;/p&gt;
&lt;p&gt;Unlike the American or British cases, the India case calls for an outright ban on Google Earth itself, rather than blurring or restrictions.&lt;/p&gt;

&lt;p&gt;Ethan Zuckerman points out &lt;a href=&quot;http://blog.wired.com/27bstroke6/2007/11/encrypted-e-mai.html&quot;&gt;this article&lt;/a&gt;, detailing the fact that the web-based version of HushMail&#039;s encrypted email service is still subject to interception by law enforcement. Law enforcement officials apparently required HushMail to alter its general policy of immediately deleting the passcode required to read encrypted email, instead turning that passcode and various email over to the police. The article questions whether HushMail&#039;s signature product, which relies on a client-side Java application to perform encryption instead of a Web interface, would also be subject to interception.&lt;/p&gt;
&lt;p&gt;Companies wishing to do business in any nation are, of course, required to comply with national laws. Whether they should voluntarily disclose information where not compelled to do so, and whether they should inform customers of the fact that account information can be obtained in this manner, are separate questions.&lt;/p&gt;

 <title>India, Orkut, and the &#039;balance of information&#039;</title>

 <description>&lt;p&gt;On October 10, 2006, Indian &lt;a href=&quot;http://timesofindia.indiatimes.com/articleshow/2136970.cms&quot;&gt;media&lt;/a&gt; reported that a two-judge panel of the Bombay High Court has directed the state government of Maharashtra to issue notice to Google for “alleged spread of hatred about India by its social network service &#039;Orkut&#039;.” &lt;/p&gt;
&lt;p&gt;The Public Interest Litigation petition filed by a 24-year old local advocate argued that this community bore an “anti-India” message, and asked for the appointment of a ‘controller’ to regulate &lt;em&gt;all&lt;/em&gt; such online communities under the &lt;a href=&quot;http://www.mit.gov.in/ngnitact.asp&quot;&gt;Information Technology Act&lt;/a&gt; of 2000 (IT Act). Special Public Interest Litigation procedures in India allow any individual to file a petition the state high courts and the Supreme Court to enforce fundamental rights.&lt;/p&gt;
&lt;p&gt;This so-called hate speech consisted of an 82-member community on Orkut called “We Hate India,” displaying a photo of protesters burning an Indian flag. On We Hate India, discussion orbits around criticism of India in its longstanding conflict with Pakistan over Kashmir.&lt;/p&gt;
&lt;p&gt;Hate is a fast and loose term in Orkut communities, with over 1000 groups dedicated to hating celebrities, politicians, math, and sports teams alongside nationalities and rival countries. A search query on Orkut communities using the terms “hate India” yielded 81 groups, with some of the largest having been newly formed in July 2006, and well over twice as many groups who “hate Pakistan.” Anecdotal evidence suggests there may be an equivalent number of groups hating those who hate either India or Pakistan. &lt;a href=&quot;http://indiauncut.blogspot.com/2006/10/indian-court-goes-after-orkut.html&quot;&gt;Bloggers&lt;/a&gt; are calling any possible move to block the group as a violation of what should be protected expression. &lt;/p&gt;
&lt;p&gt;It would be relatively easy for the Indian government to block access to this Orkut community, as it did to a Yahoo! Group in 2003 and more recently to Google’s &lt;a href=&quot;http://www.globalvoicesonline.org/2006/07/17/india-blocking-access-to-blogs-on-blogspot-and-typepad-in-india/&quot;&gt;Blogspot and other blogging platforms&lt;/a&gt; in the wake of the Bombay commuter rail bombings. In July 2003, the &lt;a href=&quot;http://www.cert-in.org.in/&quot;&gt;Indian Computer Emergency Response Team&lt;/a&gt; (CERT-In) under the Department of Information Technology was empowered by the IT Act to instruct the Department of Telecommunications to block sites it investigates. CERT-In went to work quickly, and within a month issued an order for Indian ISPs to ban the Yahoo! Group &lt;a href=&quot;http://groups.yahoo.com/group/kynhun/&quot;&gt;kynhun&lt;/a&gt;, which discussed the secession of the Indian state Meghalaya and resulted in the &lt;a href=&quot;/bulletins/003/&quot;&gt;collateral blocking&lt;/a&gt; of thousands of Yahoo! groups. &lt;/p&gt;
&lt;p&gt;Although the IT Act has no explicit provisions for the blocking of sites, it makes publishing obscene content online a punishable offence (Art. 67) and authorizes the compelled decryption of information in the interests of state sovereignty and security, foreign relations, public order, and preventing incitement to an offence (Art. 69). All of these categories are also subject to reasonable restrictions under Article 19 of the Indian &lt;a href=&quot;http://lawmin.nic.in/coi.htm&quot;&gt;Constitution&lt;/a&gt;, which guarantees freedom of speech and expression. In 2003, the same government notice that created CERT-In also authorized the blocking of websites promoting hatred, defamation, gambling, racism, violence, terrorism, pornography or violent sex, because banning such websites preserved a ‘balanced flow of information’ and did not constitute censorship. &lt;/p&gt;
&lt;p&gt;However, it is unclear whether Indian law can even be applied to compel Google to regulate the We Hate India community. Google states that its Orkut community is governed by its &lt;a href=&quot;http://www.orkut.com/terms.aspx&quot;&gt;Terms of Service&lt;/a&gt; (TOS), which it &lt;a href=&quot;http://www.business-standard.com/common/storypage_c.php?leftnm=11&amp;amp;bKeyFlag=IN&amp;amp;autono=16104&quot;&gt;claims&lt;/a&gt; strictly prohibit ‘hate speech’ and violence. The actual TOS include no mention of these categories of speech or content. Rather, Google has sole discretion to take down material it finds objectionable, including defamatory, libelous, threatening, unlawful, and obscene content. &lt;/p&gt;
&lt;p&gt;A Google spokesperson &lt;a href=&quot;http://news.com.com/2061-10812_3-6125049.html&quot;&gt;wrote&lt;/a&gt; CNet that while this petition was being taken very seriously, the company wanted “to be careful not to affect users around the world by making changes to a global product based on the law in one country.” Google also asserted that Orkut is operated from the US and complies with US law. &lt;/p&gt;
&lt;p&gt;The TOS apply to individual users only—on this social networking platform businesses, organizations or other legal entities are denied access. While international users must agree to comply with local rules of their country of residence regarding acceptable content, the &lt;a href=&quot;http://www.orkut.com/Profile.aspx?uid=8335357249619001873&quot;&gt;owner&lt;/a&gt; (registration required) of the We Hate India group is self-identified as located in Russia. &lt;/p&gt;
&lt;p&gt;The &lt;a href=&quot;http://www.satp.org/satporgtp/countries/india/document/actandordinances/the_unlawful_activities__amendord2004.htm&quot;&gt;Unlawful Activities (Prevention) Amendment Ordinance&lt;/a&gt;, enacted after the repeal of the Prevention of Terrorism Act in 2004, makes unlawful separatist activity and other acts that threaten state sovereignty or cause “disaffection” against India. However, this ordinance only applies to Indian nationals. &lt;/p&gt;
&lt;p&gt;DNA &lt;a href=&quot;http://www.dnaindia.com/report.asp?NewsID=1057774&quot;&gt;reports&lt;/a&gt; that Google would need to be hooked in as a third-party network service provider in order to be made liable here, and then the act of ‘hate speech’ itself, would potentially be punishable under Article 75 of the IT Act, which attaches liability to enumerated offenses committed outside India by any person irrespective of nationality as long as the act is committed on a computer, computer system or computer network located in India. &lt;/p&gt;

&lt;p&gt;A list of websites to block has been provided to the ISPs but the list itself has not been made public. Several bloggers have started asking people to file a &lt;a href=&quot;http://censorship.wikia.com/wiki/Blogs_and_RTI_Act&quot;&gt;Right to Information&lt;/a&gt; (RTI) requesting the government to release the list of blocked websites. Not satisfied with the intransparent situation, bloggers have been organizing themselves and &lt;http ://censorship.wikia.com/wiki/List_of_ISPs_that_seem_to_have_blocked_blogger&gt; keeping track of which ISP blocks which websites.&lt;/p&gt;
&lt;p&gt;For several days there was a general lack of further official explanation and justification for these censorship practices. As of July 19, the Deputy Consul General has come forward with a clarification, stating that:&lt;/p&gt;

A two-page write up containing extremely derogatory references to Islam and the holy prophet which had the potential to inflame religious sensitivities in India and create serious law and order problems in the country appeared in a blog facilitated by well known search engines. The matter was immediately taken note of by our CERT (Computer Emergency Response Team) and the Department of Telecommunications (DOT) was informed of it. The DOT took up the matter forthwith with the search engines and instructions were also issued to all Internet providers to block the two impertinent pages. Because of a technological error, the Internet providers went beyond what was expected of them which in turn resulted in the unfortunate blocking of all blogs. Department of Telecommunications have now clarified the issue and the error is being rectified and it is expected that normalcy in respect of blogs will soon be restored. &lt;/p&gt;&lt;/blockquote&gt;
&lt;p&gt;There have been &lt;a href=&quot;http://www.andrewlih.com/blog/2006/07/20/india-blocks-slowly-lifted&quot;&gt;recent&lt;/a&gt; signs that the blanket filtering are slowly being lifted by some ISPs. &lt;/p&gt;
&lt;p&gt;In the meantime, concerned bloggers have been communicating and organizing themselves using &lt;a href=&quot;http://groups.google.com/group/BloggersCollective&quot;&gt;Google Groups&lt;/a&gt; as well as a &lt;a href=&quot;http://censorship.wikia.com/wiki/Bloggers_Against_Censorship&quot;&gt;wiki&lt;/a&gt; that aggregates information, including information on &lt;a href=&quot;http://censorship.wikia.com/wiki/Bypassing_The_Ban&quot;&gt;how to bypass the block&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;This not the first time India has practiced Internet censorship. For example, in 2003 the state closed down a Yahoo Group, called Kyhun, that was run by a banned militant outfit, the Hynniewtrep National Liberation Council (HNLC) of the Khasi tribe in Meghalaya. &lt;p&gt;India is among a handful of democratic states that has recently implemented some form of nationwide Internet content filtering regulation. In September 2003, the Indian Ministry of Communications &amp;amp; Information Technology &lt;a href=&quot;sc1.gif&quot;&gt;ordered&lt;/a&gt; Indian Internet Service Providers (ISPs) to block the &lt;a href=&quot;http://groups.yahoo.com/group/kynhun/&quot;&gt;Yahoo! Group kynhun&lt;/a&gt;. In response, many ISPs blocked access to the entire groups.yahoo.com domain, resulting in the collateral blocking of thousands of newsgroups.&lt;/p&gt;
&lt;p&gt;More recently, an Indian media organization, Rediff.com, &lt;a href=&quot;http://us.rediff.com/news/2004/may/26hindu.htm&quot;&gt;reports that&lt;/a&gt; the Mumbai Police Commissioner&#039;s Office had ordered ISPs in India to block the website HinduUnity.org because of inflammatory anti-Islamic material contained on the website. The report also notes that there is varying compliance among ISPs, with one ISP in particular, SIFY, refusing to comply because the order had come from the Mumbai Police Commissioner&#039;s Office and not the &lt;a href=&quot;http://www.cert-in.org.in/&quot;&gt;Indian Computer Emergency Response Team&lt;/a&gt; (CERT-IN) -- a newly created unit of the Ministry of Communications &amp;amp; Information Technology whose mission is to handle computer-related security incidents.&lt;/p&gt;
&lt;p&gt;In order to ascertain compliance with the latest order, we connected to the web sites in controversy through remote computers hosted by three ISPs in India: DISHNET, VSNL, and SIFY. Despite being readily accessible from our control location in Canada, the HinduUnity.org website is indeed inaccessible from remote computers hosted on these three ISPs -- including SIFY, which was reported not to have complied with the blocking order because of the dispute over jurisdiction. It is not clear at this time why SIFY is now blocking access to HinduUnity.org.&lt;/p&gt;
&lt;p&gt;Our testing also reveals some unusual and unexpected collateral blocking. When our requests were made for HinduUnity.org, a message was displayed indicating that the requested website could not be accessed. Unlike the &quot;block pages&quot; generally delivered by commercial filtering applications, these pages are generic network errors produced by a computer&#039;s own browser indicating that a web site could not be reached. This type of error message suggests that the ISPs are complying with the order by denying access to the IP address (67.153.104.163) of HinduUnity.org as opposed to refusing to resolve the domain name itself.&lt;/p&gt;
&lt;p&gt;While simple for ISPs to perform, this type of content filtering can also unintentionally block &lt;a href=&quot;http://cyber.law.harvard.edu/people/edelman/ip-sharing/&quot;&gt;domains sharing the same IP address&lt;/a&gt;. Indeed, our testing shows that at least eight&lt;a href=&quot;#update&quot;&gt;*&lt;/a&gt; other domains, including &lt;a href=&quot;http://www.kahane.org/&quot; title=&quot;http://www.kahane.org/&quot;&gt;http://www.kahane.org/&lt;/a&gt; and &lt;a href=&quot;http://www.gwsystems.co.il/&quot; title=&quot;http://www.gwsystems.co.il/&quot;&gt;http://www.gwsystems.co.il/&lt;/a&gt;, are being filtered by the Indian ISPs because they share the same IP address as&lt;br /&gt;

It is not clear at this time whether the filtering of kahane.org is intentional or an unintentional by-product of it sharing the same IP address as HinduUnity.org, as appears to be the case with &lt;a href=&quot;http://www.gwsystems.co.il/&quot; title=&quot;http://www.gwsystems.co.il/&quot;&gt;http://www.gwsystems.co.il/&lt;/a&gt;. To our knowledge, no order has been issued by any authority in India to block kahane.org.&lt;/p&gt;
&lt;p&gt;We also tested the groups.yahoo.com domain as well as the specific Yahoo! Group kynhun to test compliance with the previously issued Ministry of Communications blocking order. We found that of the three ISP we tested, only VSNL -- the largest ISP in India -- continues to block the group. To our knowledge, no contrary order has been issued by CERT-IN or the Ministry of Communications.&lt;/p&gt;

The network connection errors indicative of Internet filtering and blocking are identical to normal errors that can occur during the course of regular Internet traffic routing.
